Welcome to Shop South. By browsing or purchasing from our website, you agree to be bound by the following Terms and Conditions. Please read them carefully before making a purchase.
Shop South (ABN: 48152097650) is an online marketplace that connects Australian customers with independent vendors based in India. We are a platform provider - we are not the seller of the goods listed on our site.
1. Agreement to These Terms
By accessing this website, browsing our products, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full, as well as our Privacy Policy. These Terms apply to every purchase made through Shop South, regardless of which vendor supplies the product.
If you do not agree with any part of these Terms and Conditions, you must not use this website or place an order. Your placement of an order constitutes your acceptance of these Terms as they appear on the website at the time the order is made.
We reserve the right to update these Terms at any time, and the version in effect at the time of your order will govern that purchase. See clause 13 (Changes to These Terms) for more detail.
2. About Our Marketplace
Shop South operates as a marketplace platform. Each product listed on our website is sold by an independent third-party vendor based anywhere in the world. Shop South facilitates the transaction but is not the merchant of record for individual product sales.
By placing an order, you are entering into a purchase agreement with the individual vendor, not with us directly. We take quality of vendors seriously and vet all sellers before they are approved to list on our platform.
3. Eligibility
To purchase from our marketplace, you must:
Be at least 18 years of age Be located in Australia Provide accurate and complete personal and payment information Not use our platform for any unlawful purpose
4. Orders & Payment
4.1 Placing an Order
When you place an order on our website, you are making an offer to purchase a product from the relevant vendor. We will send you an order confirmation email once payment has been processed successfully.
4.2 Pricing
All prices displayed on our website are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice, but any change will not affect orders already confirmed.
4.3 Payment
We accept payment via major credit cards and other methods available at checkout. All payments are processed securely. We do not store your full payment card details.
4.4 Currency & Conversion
Transactions are processed in AUD. As vendors are based in India, your bank may display the equivalent in INR for reference purposes, but you will only be charged in AUD.
5. Shipping & Delivery
5.1 International Shipping
All products are shipped from anywhere in the world to Australia by the individual vendor. Estimated delivery times are 7 to 21 business days depending on the carrier and customs processing. These are estimates only and not guaranteed delivery dates.
5.2 Shipping Costs
Shipping costs are calculated at checkout based on the vendor's location, product weight, and your delivery address in Australia.
5.3 Customs & Import Duties
For orders under AUD $1,000, Australian GST may apply and will be collected at checkout where required. You are responsible for any additional customs duties or taxes that may be imposed by Australian Border Force. We recommend checking with the Australian Border Force if you are unsure about specific product categories.
5.4 Tracking
Once your order has been dispatched, you will receive a shipping confirmation email with tracking details. You can monitor your shipment directly through the carrier's website.
6. Returns, Refunds & Australian Consumer Law
6.1 Your Rights Under Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
6.2 Change of Mind Returns
Change of mind returns are not guaranteed and are at the discretion of the individual vendor. Please review the vendor's store policy before purchasing. We encourage vendors to accept returns where reasonable.
6.3 Final Sale Items
Products marked as "Final Sale" on the product listing page and/or at checkout are sold on a no-return, no-exchange, no-refund basis, other than as set out below. By completing the purchase of an item marked as Final Sale, you acknowledge and accept that:
- You are not entitled to a change of mind return, exchange, or refund for that item;
- It is your responsibility to review the product details, sizing, and description carefully before purchasing.
This exclusion does not limit or exclude your rights under the Australian Consumer Law. If a Final Sale item is faulty, not of acceptable quality, not fit for purpose, or does not match its description, you remain entitled to a repair, replacement, refund, or compensation in accordance with clause 6.1 and clause 6.4.
6.4 Damaged or Incorrect Items
If you receive a damaged, defective, or incorrect item, please contact us within 14 days of receiving your order at info@shopsouth.com.au with your order number and photos of the issue. We will work with the vendor to arrange a replacement or refund. This applies whether or not the item was marked as Final Sale.
6.5 Refund Processing
Approved refunds will be processed to your original payment method within 5 to 10 business days. We will notify you by email once a refund has been issued.
7. Prohibited Uses
You agree not to use our website to:
Purchase goods for resale without our prior written consent Submit false, inaccurate, or misleading information Engage in fraudulent transactions Violate any applicable laws or regulations Interfere with the proper functioning of the website
8. Intellectual Property
All content on the Shop South website, including logos, text, images, and design elements, is the property of Shop South or its vendors and is protected by Australian and international copyright laws. You may not reproduce or distribute any content without prior written permission.
9. Privacy
We are committed to protecting your privacy. Our Privacy Policy, available on our website, explains how we collect, use, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth). By using our website, you consent to our Privacy Policy.
10. Limitation of Liability
Shop South is a marketplace platform. To the fullest extent permitted by law, we are not liable for:
The quality, safety, or legality of products listed by vendors The accuracy of vendor product descriptions Delays in shipping caused by vendors, carriers, or customs authorities Any indirect, incidental, or consequential loss or damage
Nothing in these Terms limits your rights under the Australian Consumer Law.
11. Dispute Resolution
If you have a complaint about a purchase, please contact us first at info@shopsouth.com.au. We will work with you and the vendor to resolve the issue within 14 business days.
If we are unable to resolve a dispute, you may contact the Australian Competition and Consumer Commission (ACCC) or your state's consumer affairs office for further assistance.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
13. Changes to These Terms
We reserve the right to update these Terms at any time. The updated version will be posted on our website with a new effective date. Your continued use of Shop South after any changes constitutes your acceptance of the new Terms.
